A question on my mind is whether we will still try to have this taxe d’urbanisme dropped by trying to convince the region
when Sarah and myself spoke to Mark end of last year, he said he still would try to negotiate with the region to have it dropped. He explained that The Spiegel tried to negociate, but it didn’t work, Mark explained this as following:The Spiegel tried to fight for it, after the region/commune already had spent it.
the fact that Oaktree is out, might make are chances of winning this, smaller
the region indicated that they are quite busy, not giving us a third encounter before introducing the permit, so don’t know if they will take time for it.
we’re talking about 170 000 euro, so not a small amount
My impression is that this decree was written with promotors in the back of their mind.
Their is not much foreseen on the level of colocs/cohousings on a legal level.
I would try to play the cohousing card + the value we bring to the commune/neighbourhood with our multipurpose room.
But maybe to be asked to Mark what arguments they used
I’m all for it, but in my mind this just doesn’t compute (but maybe that’s just professional deformation or just plain naivité ). Don’t we live in a society where taxes cannot be negotiated?
I really don’t see it personally, and I would feel more comfortable if we would be clear on which grounds this would be possible before we do anything. It’s a probably a high bar to do anything shocking when it comes to corruption in this scene, and yet I would prefer to stay on the safe side and not risk being seen as an actor that is trying to dodge taxes if there are no clear grounds based on which this can be done.

The law does mention possibility to reduce/scrape the tax - so maybe we need to see how can we mobilise the argument that cohousing fits in one of the government boxes : "
Art. 7. § 1er. La valeur des charges d’urbanisme prévue à l’article 6 peut être réduite d’un tiers :
1° lorsque le permis porte sur la réalisation d’actes et travaux situés dans un périmètre de revitalisation d’un quartier conformément à l’ordonnance du 7 octobre 1993 organique de la revitalisation des quartiers ou dans un périmètre de revitalisation urbaine conformément à l’ordonnance du 28 janvier 2010 organique de la revitalisation urbaine;
2° lorsque le permis porte sur la réalisation d’actes et travaux de mise en valeur du patrimoine immobilier classé ou inscrit sur la liste de sauvegarde;
3° lorsque le permis est délivré en application des prescriptions 0.8, 0.10 ou 4.4 du plan régional d’affectation du sol.
§ 2. L’autorité délivrante peut réduire la valeur des charges d’urbanisme au-delà de ce que prévoit le paragraphe 1er lorsqu’elle constate l’existence de circonstances exceptionnelles liées à la mise en oeuvre du permis ou des charges d’urbanisme."
Art. 9. Sont exonérés de charges d’urbanisme :
1° la réalisation de logements visés à l’article 1er, 1° et 2° ;
2° la réalisation d’espaces verts;
3° la réalisation de parkings de transit;
4° la réalisation d’équipements scolaires, culturels, sportifs, sociaux, de santé, de culte reconnus ou de morale laïque;
5° le changement de destination d’un immeuble de bureaux ou d’activités de production de biens immatériels vers le logement ou l’équipement scolaire, culturel, sportif, social, de santé, de culte reconnu ou de morale laïque; en cas d’extension, de rénovation lourde ou de démolition-reconstruction, l’exonération ne porte pas sur les superficies de plancher supplémentaires créées;
6° les permis d’urbanisme exécutant un permis de lotir dont la délivrance a donné lieu à l’imposition de charges d’urbanisme autres que celles liées à l’infrastructure nécessaire à sa mise en oeuvre.
Friday at 15:00 is quite complicated because of my job. (I’m only available from 16.30).
But we could definitively have a call before together to prepare this meeting. And/or have a debriefing after.
I will help on this topic with arguments and I will do my best to be available for the meetings in French with the commune of Jette and/or the Region, etc.
I was planning on attending the NVC training tomorrow (Tuesday). But I think I’ll take the time to start researching the topic instead.
